2019 Raffle Rules

Dirigo Marine Learning Center (DMLC) 2001 Caillou Canoe and Slick Ryder Trailer Raffle to provide scholarships for teens sailing aboard SSV Harvey Gamage is conducted by Dirigo Marine Learning Center, a nonprofit organization under the laws of Maine.  The raffle is governed by the State of Maine’s Revised Statutes (Title 17 M.R.S Chapter 62).  By purchasing a raffle ticket, you agree to be bound by these rules.

  1. The purchase price for one raffle ticket is $10.00.  600 tickets will be sold.

  2. Ticket entries can be purchased in-person from a DMLC member.

  3. Persons under 18 years of age are prohibited from the raffle unless authorized under 17 M.R.S. § 1835-A(4).

  4. Tickets may be purchased with cash only.

  5. All entry purchases are final and non-refundable.

  6. The entrant will provide their information on a raffle ticket that will be entered into the drawing and retained by DMLC.  All unsold tickets and proceeds from the raffle ticket sales must be received by DMLC no later than 5:00 p.m. EST on September 22, 2019.  If received after the official deadline, all monies will be returned to entrant(s) and all associated tickets will be invalid.

  7. The winner of the raffle will be determined by random drawing.  The drawing will either take place on September 22, 2019 at approximately 5:00 p.m. EST at Portland Yacht Services, 100 W Commercial St, Portland, ME 04102 OR when 600 tickets are sold (at either Portland Yacht Services or Portland Sports Complex, 512 Warren Ave, Portland, ME 04103) – whichever comes first.  This information will also be announced on Ocean Passages website (http://www.ocean-passages.org/dirigo-marine-learning-center-raffle) and Harvey Gamage’s Facebook page (www.facebook.com/HarveyGamageSchooner).  The entrant does not need to be present to win.

  8. The winner agrees to comply with all IRS regulations regarding raffle winnings.  The winner agrees to furnish DMLC with his/her social security number and driver’s license, verify his/her identity and sign all required IRS documents (IRS Form W-2G) before claiming the prize.  The DMLC will provide the winner with a separate IRS Form W-2G so he/she may submit it with their 2019 taxes. (You must file Form W-2G with IRS Form 1096.  This form must be ordered online by visiting www.IRS.gov/orderforms and selecting “Online Ordering for Information Returns and Employer Returns.”)

  9. The winner will assume and be responsible for all local, state and federal taxes, including but not limited to all applicable sales, use, luxury, income and special taxes associated with winning a raffle.  DMLC specifically disclaims all expressed or implied warranties, including without limitations warranties of merchantability.  DMLC is not responsible for any losses or injuries suffered as a result of the prize.

  10. The winner of the raffle must claim the prize within 14 days of the drawing by responding to telephonic or written notice from DMLC.  If the winner does not claim the prize within 14 days of the drawing, the prize will be forfeited.  If the prize is forfeited, another winner will be selected.  The prize must be physically claimed within 30 days of the drawing from Portland Yacht Services, 100 W Commercial St, Portland, ME 04102.  DMLC will not deliver the prize to the entrant.

  11. Purchasers of raffle tickets must legibly write their full names, addresses, email and telephone numbers on each individual ticket.  If more than one name is stated on a ticket, the first listed name shall be the entrant.  DMLC shall, will and can have no obligation for payment of any prize to any person other than the entrant.  It is the sole responsibility of the entrant to allocate any such prize among the participants in any multiple party entry.

  12. Any drawing may be postponed due to weather or any state of emergency declared by the Mayor of Portland, the Governor of Maine or the President of the United States.  In such an event, a new date, place and time for the drawing will be determined by DMLC, which will be announced on Ocean Passages website and Harvey Gamage’s Facebook page.

  13. Purchasers of tickets, by participating in the raffle, release DMLC, its directors, officers, members and agents from any and all liability, loss or claim arising out of any raffle prize, expressly waive any such claim and agree that the liability, if any, of the DMLC, its directors, officers, members and agents shall be limited to the raffle ticket price paid.  DMLC makes no express or implied warranty as to the raffle prize.

  14. Any and all disputes, claims and controversies concerning this raffle shall be submitted to and resolved by binding arbitration, to be conducted under arbitration rules in the state of Maine.

  15. Prize is not redeemable for cash.  The canoe and trailer are valued at $4,500 total.

  16. Prize condition is taken as is.

  17. Raffle is void where prohibited.

  18. Winner(s) agree to allow DMLC to publish their names and photographs on Ocean Passages website and Harvey Gamage’s Facebook page.
